REGULATORY DATA GOVERNANCE
Insurance & Liability Policy
1.PURPOSE
The purpose of this Insurance & Liability Policy ("Policy") is to define the insurance responsibilities and liability expectations applicable to users and service providers using the MiFix360 Platform.
This Policy aims to:
• promote responsible service delivery;
• reduce operational risk;
• protect users and service providers;
• support institutional and enterprise engagements;
• encourage appropriate insurance coverage.
2.PLATFORM ROLE
MiFix360 is a digital marketplace that connects users with independent service providers.
MiFix360:
• is not an employer;
• is not a contractor;
• is not an insurer;
• does not provide insurance coverage for users or service providers unless expressly stated in writing.
Users and providers remain solely responsible for obtaining and maintaining appropriate insurance cover.
3.GENERAL LIABILITY PRINCIPLES
Users and service providers acknowledge that:
• all services are performed at their own risk;
• MiFix360 does not guarantee service outcomes;
• MiFix360 does not guarantee the conduct of users or providers;
• each party remains responsible for its own acts, omissions, negligence and legal obligations.
4.LEVEL 1 SERVICE PROVIDERS
Examples:
• Cleaning;
• Gardening;
• Car Wash;
• General Labour;
• Moving Assistance.
Insurance is not mandatory for Level 1 providers.
However, MiFix360 strongly recommends that providers consider obtaining:
• personal accident insurance;
• public liability insurance where reasonably appropriate.
5.LEVEL 2 SERVICE PROVIDERS
Examples:
• Plumbing repairs;
• Locksmith services;
• Appliance repairs;
• Electrical maintenance.
MiFix360 recommends that Level 2 providers maintain:
• public liability insurance;
• vehicle insurance (where applicable);
• tool and equipment insurance.
6.LEVEL 3 SERVICE PROVIDERS
Examples:
• Renovations;
• Construction;
• Mechanical services;
• Medium-scale installations.
Level 3 providers are strongly encouraged and may be required to maintain:
• Public Liability Insurance;
• Contractor's All Risk Insurance;
• Vehicle Insurance;
• Workman's Compensation / Compensation Fund Registration;
• Tool and Equipment Insurance.
MiFix360 reserves the right to request proof of insurance before approving or maintaining Level 3 verification status.
7.LEVEL 4 ENTERPRISE PROVIDERS
Examples:
• Major construction projects;
• Institutional maintenance contracts;
• Infrastructure works;
• Enterprise service agreements.
Level 4 providers shall, where applicable, maintain adequate insurance cover appropriate to the nature and scale of work, including:
• Public Liability Insurance;
• Professional Indemnity Insurance;
• Contractor's All Risk Insurance;
• Employer's Liability Insurance;
• Workman's Compensation Registration;
• Motor Vehicle Insurance;
• Plant and Equipment Insurance;
• Professional Registration and Licensing.
Proof of insurance may be requested during onboarding, renewal, or institutional engagements.
8.PROFESSIONAL INDEMNITY INSURANCE
Professional Indemnity Insurance is recommended or required for providers rendering professional advisory or design services including but not limited to:
• Engineers;
• Architects;
• Quantity Surveyors;
• Project Managers;
• Consultants;
• Designers.
9.MOTOR VEHICLE SERVICES
Providers offering:
• towing;
• roadside assistance;
• transportation;
• delivery services;
shall ensure that vehicles used:
• are roadworthy;
• are legally licensed;
• are appropriately insured.
10.PROPERTY DAMAGE
Service providers shall be liable for damage caused through:
• negligence;
• misconduct;
• unlawful conduct;
• breach of contract.
MiFix360 accepts no liability for damages caused by independent service providers.
11.USER RESPONSIBILITIES
Users are encouraged to:
• verify insurance documentation where appropriate;
• request proof of insurance for high-value works;
• conduct additional due diligence for enterprise engagements.
12.INSTITUTIONAL AND ENTERPRISE ENGAGEMENTS
Institutions and corporate clients may impose additional insurance requirements.
MiFix360 reserves the right to require providers participating in institutional or enterprise projects to submit:
• insurance certificates;
• proof of compliance;
• statutory registrations.
13.NO PLATFORM INSURANCE
Unless expressly agreed in writing, MiFix360 does not provide:
• public liability insurance;
• professional indemnity insurance;
• workman's compensation;
• accident insurance;
• theft insurance;
• medical insurance.
14.LIMITATION OF LIABILITY
To the maximum extent permitted by law, MiFix360 shall not be liable for:
• property damage;
• defective workmanship;
• professional negligence;
• delays;
• personal injury;
• death;
• consequential damages.
Nothing in this Policy excludes liability that cannot legally be excluded under South African law.
15.POLICY REVIEW
MiFix360 reserves the right to amend this Policy from time to time.
Updated versions shall be published on the Platform and website.
